{"id":8689,"date":"2026-05-04T06:22:35","date_gmt":"2026-05-04T06:22:35","guid":{"rendered":"https:\/\/lawsandlegals.com\/english\/?p=8689"},"modified":"2026-05-04T06:22:36","modified_gmt":"2026-05-04T06:22:36","slug":"supreme-court-orders-shift-of-excess-deer-from-hauz-khas-park-cites-lack-of-capacity","status":"publish","type":"post","link":"https:\/\/lawsandlegals.com\/english\/supreme-court-orders-shift-of-excess-deer-from-hauz-khas-park-cites-lack-of-capacity\/","title":{"rendered":"SC allows relocation of hundreds deer from Delhi\u2019s A N Jha Deer Park to Rajasthan"},"content":{"rendered":"\n<p><strong>New Delhi:<\/strong> The Supreme Court has allowed the relocation of hundreds of spotted deer from A N Jha Deer Park in Delhi\u2019s Hauz Khas to different wildlife sanctuaries or tiger reserves in Rajasthan observing that the park lacks the requisite carrying capacity to sustain such a large population. However, the top court allowed the park to retain up to 38 deer, subject to approval.<\/p>\n\n\n\n<p>A bench of Justices Vikram Nath and Sandeep Mehta order came while upholding the Delhi High Court decision. <\/p>\n\n\n\n<p>The bench said, \u201cWe are of the considered opinion that the impugned order dated 19th July, 2024 passed by the High Court of Delhi, whereby the additional affidavit filed by the DDA proposing relocation of the deer from the A.N. Jha Deer Park, with retention of approximately two dozen deer subject to obtaining recognition from the Central Zoo Authority, was accepted. <\/p>\n\n\n\n<p>As well as the impugned order dated 24th January, 2025, whereby the application seeking recall of the order dated 19th July, 2024 came to be dismissed, cannot be said to be unjustified or suffering from any legal infirmity.\u201d<\/p>\n\n\n\n<p>The top court directed the authorities concerned to take necessary steps for the relocation of the deer from A.N. Jha Deer Park in a time-bound manner, under the supervision of the Central Empowered Committee, and in strict adherence to the draft guidelines on Animal Translocation as framed by the Central Empowered Committee.<\/p>\n\n\n\n<p>The court also made it clear that retention of up to 38 deer at A.N. Jha Deer Park as recommended by the Central Empowered Committee shall be permissible only subject to the grant of requisite approvals and clearances by the Central Zoo Authority.<\/p>\n\n\n\n<p>The court also said that the DDA shall ensure that it develops and upgrades the necessary logistical capacity, infrastructure, and adequately trained human resources for the upkeep and management of the said deer population. <\/p>\n\n\n\n<p>The DDA shall ensure that the retained population has an optimal sex ratio of 15 males to 23 females. Such retention shall be effected only upon and in accordance with the permissions granted by the Central Zoo Authority.<\/p>\n\n\n\n<p>In case, the DDA is unable to attain these mandatory compliances, appropriate application may be moved in this Court for clarification\/further directions, the top court said.<\/p>\n\n\n\n<p>Taking into account that A.N. Jha Deer Park authorities lack the requisite financial resources as well as infrastructural capacity to effectively fulfil the objectives for which the said deer park was originally established, the court said that the continuance of the existing arrangement does not commend acceptance.<\/p>\n\n\n\n<p>This position is further reinforced by the opinion of the Central Empowered Committee, an independent expert body, which has categorically observed that the A.N.
