If pending cases exceed 15, two courts should be established, and where pendency crosses 25 cases, three courts must be created.

The directions came in a suo motu case initiated earlier this year to address delays in trials under special anti-terror laws. The Court emphasised that judges assigned to these courts should exclusively handle NIA and UAPA matters and should not be burdened with other judicial work.

The Bench also ordered that trials before these courts should proceed on a day-to-day basis. Trial courts were asked to ensure that at least one trial is concluded every month, while retaining discretion over daily case listings.

Further, the Supreme Court directed the Union government, the NIA and State authorities to coordinate with High Courts to provide adequate infrastructure and exclusive space for these special courts.
