However, there is no uniform legal framework or standard safety mechanism to protect them while working in these environments.

According to the petition, several incidents in recent years have involved allegations of intimidation, harassment, assault, and even sexual misconduct against women lawyers inside police stations. It argues that these incidents have created a sense of insecurity among female advocates and may discourage them from carrying out their professional responsibilities, especially during late-night visits or in sensitive cases.

The petition refers to incidents from Noida and Karnataka, claiming they reflect a broader systemic problem rather than isolated events. It argues that the lack of safety measures violates women lawyers’ constitutional rights, including the right to equality, the right to life and personal liberty, and the freedom to practice their profession.

To address these concerns, the petition seeks several safeguards, including a nationwide Standard Operating Procedure (SOP) for police stations, mandatory presence of female police officers during late-night interactions with women lawyers, CCTV cameras with audio recording, digital monitoring systems, an independent complaint mechanism, designated nodal officers for lawyers’ safety, and gender-sensitisation training for police personnel.

The petition also cites the landmark Vishaka v. State of Rajasthan case, arguing that just as the Supreme Court created guidelines against workplace sexual harassment before a law existed, it should now fill the legal gap regarding the safety of women lawyers in police stations.

A bench of Justice Vikram Nath and Justice Sandeep Mehta has issued notices to all concerned authorities and asked them to explain the existing safety measures and suggest possible improvements. The Court has not passed any final directions yet and will decide the next course of action after reviewing their responses.

New Delhi: The Supreme Court has sought responses from the Central Government, all State Governments, and the Bar Council of India on a public interest litigation (PIL) that raises concerns about the safety of women lawyers in police stations.
