In such circumstances, courts must exercise great caution while deciding bail applications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case involved two students, one from Tanzania and the other from Kenya, who were studying at Rajasthan University.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the police, they were arrested on November 11, 2025, from Hotel Green Vista in Jaipur&#8217;s Malviya Nagar area. Police claimed that cocaine was recovered from their possession, leading to the registration of a case under the NDPS Act, the Bharatiya Nyaya Sanhita (BNS), and the Foreigners Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Investigators further found that both students had entered India on student visas, but their visas had expired long ago and they had continued to stay in the country without valid authorization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Seeking bail, the students argued that they were genuine university students and that the quantity of cocaine allegedly recovered from them did not fall within the commercial quantity category under the NDPS Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their counsel told the court that the total recovered substance weighed 4.26 grams and the pure cocaine content was 3.94 grams, whereas commercial quantity for cocaine is fixed at 100 grams. The defence also emphasized that neither of the accused had any previous criminal record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Opposing the bail pleas, Additional Solicitor General Bharat Vyas argued that both accused were foreign nationals who had been living in India illegally for a long period after the expiry of their visas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution stated that they had not followed any lawful procedure to extend their visas and were found in possession of a narcotic substance while staying in the country without valid documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the hearing, an official from the Foreigners Regional Registration Office (FRRO), Jaipur, informed the court that more than 15,000 foreign nationals were allegedly residing illegally in Rajasthan. The officer also stated that several such individuals had been found involved in unlawful activities, including offences under the NDPS Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court treated this information as a matter of serious concern, observing that the issue extended beyond an ordinary bail application and raised larger questions relating to law enforcement and monitoring of foreign nationals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court also referred to an earlier NDPS case in which a foreign national had been granted bail but later failed to appear before the trial court.
