{"id":8938,"date":"2026-06-04T10:39:03","date_gmt":"2026-06-04T10:39:03","guid":{"rendered":"https:\/\/lawsandlegals.com\/english\/?p=8938"},"modified":"2026-06-04T10:39:04","modified_gmt":"2026-06-04T10:39:04","slug":"long-separation-failed-mediation-justify-divorce-sc","status":"publish","type":"post","link":"https:\/\/lawsandlegals.com\/english\/long-separation-failed-mediation-justify-divorce-sc\/","title":{"rendered":"Long Separation, Failed Mediation Justify Divorce: SC"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>New Delhi:<\/strong> The Supreme Court, in a matrimonial dispute from Rajasthan, has ruled that when a husband and wife have been living separately, have lost emotional connection, and have no realistic chance of reconciliation, forcing them to remain married can amount to mental cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A bench of Justice Sanjay Karol and Justice Augustine George Masih upheld a Rajasthan High Court judgment granting divorce to a doctor and rejected the wife&#8217;s appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case involved a doctor couple. The husband had filed for divorce in 2009 under the Hindu Marriage Act, alleging mental cruelty. He claimed that the marriage never functioned normally from the beginning and that the couple had serious differences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Court initially refused to grant divorce. However, the Rajasthan High Court later overturned that decision and dissolved the marriage. The wife then challenged the High Court&#8217;s ruling before the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the proceedings, the Supreme Court found that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The couple had been living separately for nearly 15 years.<br>Their marital relationship had completely broken down.<br>Mediation efforts ordered by the Supreme Court failed.<br>Both spouses were government doctors and financially independent.<br>The couple had no children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court stressed that marriage is not merely a legal contract but a relationship built on mutual respect, emotional companionship, shared expectations, and responsibilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If these fundamental elements disappear and the spouses continue to live separate lives for years, maintaining the marriage only as a legal formality serves little purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court observed that long-term separation, emotional distance, and lack of genuine efforts to get together can lead to mental cruelty and may justify divorce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment also addressed physical intimacy within marriage. The husband alleged that in the early years of the marriage, his wife would often lock herself in her room, forcing him to sleep separately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court noted that the fact that they slept in separate rooms was not disputed. Referring to earlier decisions, the Court reiterated that persistent denial of marital relations without reasonable cause can amount to mental cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important observations made by the court was that a marriage may sometimes survive only &#8220;on paper.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a relationship has completely broken down and there is no possibility of the spouses reuniting, forcing them to remain married can cause continued emotional suffering, frustration, and psychological harm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Invoking its powers under Article 142 of the Constitution to do &#8220;complete justice,&#8221; the Supreme Court concluded that the marriage had completely collapsed and could not be revived. It therefore upheld the divorce and dismissed the wife&#8217;s appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment is important because it signals that courts will look beyond technical legal grounds and examine the actual state of a marriage.
