{"id":8945,"date":"2026-06-05T09:44:57","date_gmt":"2026-06-05T09:44:57","guid":{"rendered":"https:\/\/lawsandlegals.com\/english\/?p=8945"},"modified":"2026-06-05T09:44:57","modified_gmt":"2026-06-05T09:44:57","slug":"hindi-not-mandatory-for-narco-test-rajasthan-hc-says-while-ordering-reinvestigation","status":"publish","type":"post","link":"https:\/\/lawsandlegals.com\/english\/hindi-not-mandatory-for-narco-test-rajasthan-hc-says-while-ordering-reinvestigation\/","title":{"rendered":"Hindi not mandatory for narco test, Rajasthan HC says while ordering reinvestigation"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Jaipur:<\/strong> In a strong rebuke of the police investigation, the Rajasthan High Court has ordered a fresh probe into a murder case from Dausa, observing that the pursuit of justice cannot be hindered by language barriers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pointing to serious lapses in the investigation, the court stressed that language must never become an obstacle in uncovering the truth and that an investigation cannot be closed simply because several years have passed or because the accused has not been identified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case was filed in 2015 by Feli Ram Meena, who alleged that his brother had been murdered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the investigation, police were unable to identify any suspects and eventually filed a closure report, saying that despite their efforts, the culprits could not be traced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A magistrate accepted this report in 2022, following which the complainant approached the high court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While hearing the matter, the court found that the investigating officer had earlier sought permission to conduct a narco test on the complainant and that the complainant had consented to it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the test was never conducted because the concerned authority said the complainant was not sufficiently familiar with Hindi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Anoop Kumar Dhand expressed surprise over this reasoning and said it could not be accepted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court observed that if a person is willing to undergo a narco test, the authorities cannot refuse it merely because the person does not speak Hindi. Instead, they should arrange for an interpreter or a person who understands the individual&#8217;s mother tongue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court noted that language cannot be allowed to become an obstacle in the search for truth.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also referred to the Supreme Court&#8217;s ruling in Selvi v. State of Karnataka Judgment, which recognizes the role of interpreters and language experts during such procedures whenever required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court was also critical of the police decision to close the case on the ground that more than six years had passed and the accused remained unknown. It said that many murder cases begin without any identified suspects and that investigators are expected to keep pursuing all possible leads.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Simply stating that the accused could not be found is not enough to bring a murder investigation to an end.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Observing that the probe had not been conducted with the seriousness expected in such a grave offence, the High Court set aside the magistrate&#8217;s order accepting the closure report and directed a fresh investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It ordered that the probe be conducted by an officer not below the rank of Circle Inspector and asked the police to submit a fresh report after completing the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court also said that if required, narco tests of the complainant, witnesses or suspects may be conducted in accordance with law and after following all necessary safeguards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To conclude, the High Court&#8217;s message was clear: a person&#8217;s inability to speak Hindi cannot be a reason to deny an investigative procedure, and a murder case cannot be closed merely because time has passed or the accused has not yet been identified.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jaipur: In a strong rebuke of the police investigation, the Rajasthan High Court has ordered a fresh probe into a murder case from Dausa, observing that the pursuit of justice cannot be hindered by language barriers.
