{"id":8957,"date":"2026-06-08T08:22:38","date_gmt":"2026-06-08T08:22:38","guid":{"rendered":"https:\/\/lawsandlegals.com\/english\/?p=8957"},"modified":"2026-06-08T08:25:39","modified_gmt":"2026-06-08T08:25:39","slug":"sc-accused-entitled-to-chargesheet-documents-even-in-official-secrets-act-cases","status":"publish","type":"post","link":"https:\/\/lawsandlegals.com\/english\/sc-accused-entitled-to-chargesheet-documents-even-in-official-secrets-act-cases\/","title":{"rendered":"SC: Accused entitled to chargesheet documents even in Official Secrets Act cases"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>New Delhi:<\/strong> The Supreme Court in a significant judgement has ruled that even in cases registered under the Official Secrets Act (OSA), an accused person has the right to receive copies of the documents that form part of the chargesheet and are relied upon by the prosecution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court said that this right cannot be denied merely because the documents are confidential or because there is a general concern that their disclosure could affect national security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case concerned to retired Major General V.K. Singh, who had served in the Indian Army and later worked as a Joint Secretary in the Research and Analysis Wing (RAW).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Proceedings were initiated against him after he published a book titled India&#8217;s External Intelligence \u2013 Secrets of Research and Analysis Wing (RAW).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Investigating agency alleged that the book disclosed sensitive information that could affect India&#8217;s security and strategic interests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After filing the chargesheet, the CBI requested that certain confidential documents be kept in sealed cover. V.K. Singh then sought copies of the documents under the law, arguing that he needed them to prepare his defence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the trial court agreed and directed that copies be supplied, the Delhi High Court modified the order and allowed him only to inspect the documents in court instead of receiving copies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court disagreed with the high court&#8217;s approach and held that merely allowing inspection of documents is not sufficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It observed that an accused must have a meaningful opportunity to defend himself, and this requires access to copies of the documents relied upon by the prosecution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court said that without copies, an accused may not be able to properly consult lawyers, prepare legal arguments, plan cross-examination of witnesses, or effectively challenge the prosecution&#8217;s case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CBI argued that providing copies could pose a risk to national security because the documents were highly sensitive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the Supreme Court said that a statutory right cannot be taken away based on a mere apprehension of harm. The prosecution had not demonstrated any specific or direct threat that would arise from providing the documents to the accused.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court also relied on its 1981 decision in the Satyen Bhowmick case, where it had held that an accused is entitled to access the material being used against him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reaffirming that principle, the court stated that the Official Secrets Act does not override the basic requirements of a fair trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the court clarified that giving documents to the accused does not permit their public disclosure. The accused, lawyers, and others involved in the proceedings remain legally bound to maintain confidentiality, and any misuse of the information can still attract action under the Official Secrets Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Setting aside the Delhi High Court&#8217;s order, the Supreme Court directed the CBI to provide typed copies of the requested documents to V.K.
