Jaipur:<\/strong> Rajasthan High Court has granted interim relief to Hanuman Beniwal, directing the police not to take any coercive action against him in connection with an FIR registered at Padu Kalan Police Station in Nagaur district.<\/p>\n\n\n\n

The interim order was passed by Justice Farjand Ali while hearing Beniwal’s criminal miscellaneous petition challenging the FIR registered under provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, and Section 8B of the National Highways Act, 1956.<\/p>\n\n\n\n

The Court has listed the matter for further hearing after three weeks.<\/p>\n\n\n\n

The FIR (No. 119\/2026) was registered on 28 May 2026 against Beniwal and 13 others in relation to a political meeting and a subsequent procession held on 6 January 2026 at Riyan Badi in Nagaur district.<\/p>\n\n\n\n

The gathering was reportedly organised to protest against the alleged sand mafia. The FIR invokes Sections 189(2), 223(a), and 285 of the BNS, 2023, along with Section 8B of the National Highways Act.
<\/p>\n\n\n\n

After the FIR was registered, Beniwal approached the High Court seeking to have it quashed. He argued that the case had been registered contrary to law and that his political activities had been wrongly given a criminal colour.<\/p>\n\n\n\n

After examining the FIR and the material placed before it, the High Court observed that the case raises important legal issues that require detailed judicial examination.<\/p>\n\n\n\n

The Court also noted that it may exercise its inherent powers under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, while considering the matter.<\/p>\n\n\n\n

The Court specifically observed that the allegations relate to a political meeting and the procession that followed, in which several people, including Beniwal, were alleged to have participated. It remarked that merely participating in a political programme does not automatically establish individual criminal liability.<\/p>\n\n\n\n

The Court said it would be necessary to examine whether there are specific allegations or evidence linking Beniwal personally to the alleged offences.<\/p>\n\n\n\n

During the hearing, the State Government, represented by the Additional Advocate General, sought time to file its reply. Since the State had already entered its appearance, the Court did not issue a fresh notice and instead granted time to submit a detailed response.<\/p>\n\n\n\n

Pending further consideration of the case, the High Court directed that no coercive action be taken against Hanuman Beniwal until the next hearing.<\/p>\n\n\n\n

The matter will now be heard again after the State Government files its reply, following which the Court will consider the merits of Beniwal’s challenge to the FIR.<\/p>\n","protected":false},"excerpt":{"rendered":"
