{"id":9081,"date":"2026-07-13T10:18:10","date_gmt":"2026-07-13T10:18:10","guid":{"rendered":"https:\/\/lawsandlegals.com\/english\/?p=9081"},"modified":"2026-07-13T10:18:11","modified_gmt":"2026-07-13T10:18:11","slug":"rajasthan-hc-mbc-candidates-cannot-claim-obc-reservation-in-reet-recruitment","status":"publish","type":"post","link":"https:\/\/lawsandlegals.com\/english\/rajasthan-hc-mbc-candidates-cannot-claim-obc-reservation-in-reet-recruitment\/","title":{"rendered":"Rajasthan HC: MBC Candidates Cannot Claim OBC Reservation in REET Recruitment"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Jaipur:<\/strong> The Rajasthan High Court has ruled that candidates belonging to the Most Backward Class (MBC) category cannot claim the benefit of reservation under the Other Backward Class (OBC) category in the REET-2021 Grade III Teacher (Level-I) Recruitment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Ashok Kumar Jain dismissed all the petitions challenging the revised selection list and upheld the revised selection list issued by the State Government on 2 May 2022.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute arose after the State Government issued selection lists on 17 April and 27 April 2022, in which the petitioners were selected and allotted districts for appointment. However, when a revised selection list was published on 2 May 2022, their names were removed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners challenged the revised list before the High Court, arguing that the MBC category is a sub-class of OBC and, therefore, MBC candidates should also be eligible for appointments against OBC reserved seats.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They sought restoration of the original selection list and appointments based on it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State Government defended the revised list by stating that the initial selection lists contained an error in the implementation of the reservation policy. It argued that the mistake was corrected by issuing the revised list.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the government, MBC is a separate reserved category, and its candidates cannot claim reservation benefits under OBC. Once candidates were adjusted according to their correct category, the cut-off marks changed, resulting in some candidates being excluded from the selection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After considering both sides, the High Court examined the provisions of the Rajasthan Backward Classes (Reservation) Act, 2017 and its 2019 amendment, which introduced a separate 5% reservation for the MBC category.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that since MBC has been recognized as an independent reserved category under the law, MBC candidates cannot simultaneously seek reservation under the OBC quota.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court further observed that if the original selection list had been prepared in violation of the reservation law, the State Government had the authority to rectify the mistake by issuing a revised selection list. Correcting such an error could not be treated as illegal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners had relied on the decision in Bharat Kumar Choudhary v. Union of India, but the High Court held that the case related to reservation for Persons with Disabilities (PwD) in the NEET admission process and had no relevance to the reservation issue involved in the REET teacher recruitment. Therefore, that judgment could not be applied to the present case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, the Rajasthan High Court dismissed all the petitions and upheld the validity of the 2 May 2022 revised selection list.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment clarifies that MBC candidates can claim only the reservation specifically provided for the MBC category and cannot seek reservation benefits under the OBC category, while also affirming the government&#8217;s power to correct an erroneous selection list to ensure compliance with the law.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jaipur: The Rajasthan High Court has ruled that candidates belonging to the Most Backward Class (MBC) category cannot claim the benefit of reservation under the Other Backward Class (OBC) category in the REET-2021 Grade III Teacher (Level-I) Recruitment.
