Jaipur:<\/strong> The Rajasthan High Court has refused to give another chance to an MBBS student to clear his remaining final-year papers. The Court said that while it understands the student’s situation, public interest and patient safety are more important than giving repeated opportunities.<\/p>\n\n\n\n

The appellant had taken admission to the MBBS course at NIMS University in 2010. He argued that when he joined the course, there was no maximum time limit for completing MBBS and, therefore, the 10-year cap introduced under the 2019 Graduate Medical Education Regulations could not be applied to him retrospectively. He sought permission to appear in the remaining papers of Medicine and Obstetrics & Gynaecology.<\/p>\n\n\n\n

However, the Division Bench of Justice Arun Monga and Justice Maneesh Sharma noted that the student’s academic record spoke for itself. Over nearly 14 years, he repeatedly failed at different stages of the MBBS course despite being granted numerous opportunities to reappear in examinations.<\/p>\n\n\n\n

The Court also recalled that, during the pendency of the appeal, a coordinate bench had granted the student one additional opportunity in 2024 to appear in the MBBS Final Professional Part-II examination. Even then, he failed to clear the remaining subjects.<\/p>\n\n\n\n

Rejecting the plea that his career and financial investment deserved consideration, the Bench observed that an MBBS degree is not merely an academic qualification but a licence to treat patients.<\/p>\n\n\n\n

It held that courts cannot ignore patient safety by permitting a candidate, who has failed to demonstrate the minimum required competence despite repeated attempts over 14 years, to continue seeking fresh opportunities.<\/p>\n\n\n\n

Finding no reason to interfere with the Single Judge’s order.<\/p>\n\n\n\n

The High Court dismissed the special appeal and declined to grant any further opportunity to the appellant.<\/p>\n\n\n\n
