{"id":9150,"date":"2026-07-22T10:57:58","date_gmt":"2026-07-22T10:57:58","guid":{"rendered":"https:\/\/lawsandlegals.com\/english\/?p=9150"},"modified":"2026-07-22T12:55:04","modified_gmt":"2026-07-22T12:55:04","slug":"supreme-court-modifies-interim-order-on-judges-retirement-age-seeks-stand-of-all-states-and-high-courts-on-raising-retirement-age-to-61","status":"publish","type":"post","link":"https:\/\/lawsandlegals.com\/english\/supreme-court-modifies-interim-order-on-judges-retirement-age-seeks-stand-of-all-states-and-high-courts-on-raising-retirement-age-to-61\/","title":{"rendered":"Supreme Court Modifies Interim Order on Judges\u2019 Retirement Age; Seeks Stand of All States and High Courts on Raising Retirement Age to 61"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>New Delhi:<\/strong> The Supreme Court has modified its interim order dated July 13, 2026 regarding the retirement age of district-level judicial officers in Rajasthan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A three-judge Bench headed by the Chief Justice of India, while hearing the All India Judges Association case, clarified that the benefit of continuing in service beyond the existing retirement age of 60 years will be available only in those States where both the State Government and the High Court have recommended increasing the retirement age.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the hearing, the State of Rajasthan informed the Supreme Court that the retirement age for both State employees and district-level judicial officers is 60 years, and that no recommendation has been made to increase it. The Court also noted that several other States opposed a general enhancement of the retirement age.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court also considered the position in Madhya Pradesh and Telangana, where the issue of increasing the retirement age had arisen in separate proceedings involving recommendations from the respective State Governments. The Court noted that the subsequent developments in Madhya Pradesh were on a different footing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In view of this, the Supreme Court modified its July 13 interim protection for Rajasthan and other States that filed similar applications. The Court has directed all State Governments and High Courts to file affidavits clearly stating their stand on increasing the retirement age of judicial officers from 60 to 61 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The matter will next be heard on August 5, 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court will consider the issue on a pan-India basis.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>New Delhi: The Supreme Court has modified its interim order dated July 13, 2026 regarding the retirement age of district-level judicial officers in Rajasthan.
