{"id":9225,"date":"2026-07-28T10:45:48","date_gmt":"2026-07-28T10:45:48","guid":{"rendered":"https:\/\/lawsandlegals.com\/english\/?p=9225"},"modified":"2026-07-28T10:45:49","modified_gmt":"2026-07-28T10:45:49","slug":"rajasthan-hc-unregistered-sale-agreement-admissible-in-specific-performance-suit-but-only-after-stamp-duty-compliance","status":"publish","type":"post","link":"https:\/\/lawsandlegals.com\/english\/rajasthan-hc-unregistered-sale-agreement-admissible-in-specific-performance-suit-but-only-after-stamp-duty-compliance\/","title":{"rendered":"Rajasthan HC: Unregistered Sale Agreement Admissible in Specific Performance Suit, But Only After Stamp Duty Compliance"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Jodhpur:<\/strong> In a significant ruling on the admissibility of agreements to sell, the Rajasthan High Court has held that an unregistered agreement to sell can be relied upon in a suit for specific performance, but it cannot be admitted in evidence unless the mandatory requirements of the Rajasthan Stamp Act are first complied with, if the document is insufficiently stamped.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Farjand Ali passed the order while deciding a writ petition challenging a trial court&#8217;s refusal to direct compliance with the stamp law before admitting an agreement to sell in evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court observed that although Section 49 of the Registration Act, 1908 permits an unregistered agreement to sell to be received as evidence in a suit for specific performance, Section 39 of the Rajasthan Stamp Act, 1998 makes it mandatory that an instrument chargeable with stamp duty cannot be admitted in evidence unless it is duly stamped.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, the High Court directed that if the agreement dated 24 January 2003 is found to be insufficiently stamped, the trial court must first impound the document and send it to the Collector (Stamps) to determine the deficient stamp duty and any applicable penalty.
