The Rajasthan High Court has suspended the life sentence of a murder convict, Rajendra Singh, pending the adjudication of his criminal appeal, observing that the prosecution case presents arguable issues and that the possibility of his acquittal cannot be ruled out at this stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rajendra Singh was convicted by the Additional District and Sessions Judge, Raisinghnagar, in 2023 for offences under Sections 302 and 120B of the Indian Penal Code and sentenced to life imprisonment. He moved the High Court seeking suspension of his sentence during the pendency of his appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before the Court, the petitioner contended that he had remained in custody for over four years, had complied with all bail conditions during trial, and that there was no immediate possibility of the appeal being taken up for final hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence submitted that several material prosecution witnesses, including eyewitnesses and the injured witness, had turned hostile during trial, resulting in the acquittal of certain co-accused. It also pointed out that some co-accused were acquitted after these witnesses failed to support the prosecution&#8217;s case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was contended that the prosecution&#8217;s case against Rajendra Singh substantially rested on the testimony of the deceased&#8217;s brother and father-in-law, whose presence at the scene had itself been questioned during cross-examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After examining the record, the Division Bench of Justice Pushpendra Singh Bhati and Justice Praveer Bhatnagar observed that the two witnesses who implicated the petitioner were not present during the initial altercation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court said, at this stage, the possibility of the petitioner&#8217;s acquittal could not be ruled out.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jaipur: Rajasthan HC Grants Bail to Murder Convict, Says Possibility of Acquittal Cannot Be Ruled Out in Case of Pending Appeal.
