While undergoing treatment in Kathmandu, she suffered an accidental fall and sustained fractures. Her services were terminated in November 2012, with effect from October 9, 2011, on the ground of unauthorised and wilful absence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The teacher claimed that she became aware of the termination only after obtaining records through RTI in September 2019. However, the Court noted that her own case showed she had learned about the termination in July 2013, when she approached the authorities to rejoin duty. She had also submitted a representation to the Governor in November 2013 challenging the termination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that the RTI documents did not give her a fresh cause of action, as she was already aware of the termination since 2013. It further observed that repeated representations and legal notices cannot extend the time for approaching the Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bench also noted that the teacher\u2019s illness could explain her absence from duty until 2013, but not her subsequent six-year inaction.
