Jodhpur<\/strong>: The Rajasthan High Court has taken a strict view of a case involving a non-advocate who allegedly represented himself as an advocate before a trial court, and has made it clear that a person cannot practise or present himself as an advocate without being enrolled with the State Bar Council.<\/p>\n\n\n\n

Justice Ravi Chirania refused to quash the FIR and dismissed the petition filed by a man accused of appearing before the trial court as an advocate despite not being enrolled as one.<\/p>\n\n\n\n

The Court also imposed \u20b950,000 in costs on him.<\/p>\n\n\n\n

Petitioner Denies Posing as Advocate Before Trial Court<\/h4>\n\n\n\n

The petitioner told the High Court that he had never claimed to be an advocate and had not done anything before the court that only an advocate could do.<\/p>\n\n\n\n

What was the case?<\/h4>\n\n\n\n

The case arose after an FIR was registered against the petitioner on allegations that he had appeared before the trial court as an advocate despite not being enrolled as one.<\/p>\n\n\n\n

The petitioner denied the allegation, claiming that he had never represented himself as an advocate or performed any work reserved for advocates.<\/p>\n\n\n\n

However, the High Court, after examining the FIR and hearing the parties, found that the petitioner had appeared as an advocate in certain cases and filed documents before the courts, despite not having the required enrolment.<\/p>\n\n\n\n

The Court also noted that on one occasion, when he appeared before a court, some advocates tried to apprehend him, but he allegedly escaped by scaling the wall of the court premises.<\/p>\n\n\n\n

Following the incident, the FIR was registered against him.<\/p>\n\n\n\n

Upon which the court seek assistance from Senior Advocate Anand Purohit, a former Bar Association President<\/em>, to understand the rival versions presented by the parties.<\/p>\n\n\n\n

Observation made By Senior advocate<\/h4>\n\n\n\n

Senior Advocate Mr. Anand Purohit, informed the Court that after hearing versions of both the parties that the petition deserved to be dismissed with costs.<\/p>\n\n\n\n

Petitioner seeks for withdrawal<\/h4>\n\n\n\n

The High Court also noted that when the Court pointed out the relevant facts, the petitioner sought to withdraw his petition. According to the Court, this conduct further supported the allegations made in the FIR.<\/p>\n\n\n\n

The Court, however, rejected the petitioner\u2019s request to withdraw the application.<\/p>\n\n\n\n

\u2018Enrolment With Bar Council Is Necessary\u2019<\/h4>\n\n\n\n

The Court also observed that under the Advocates Act, 1961, no person can practise as an advocate or represent himself as one unless he is duly enrolled with the concerned State Bar Council.<\/p>\n\n\n\n

Finding no reason to interfere with the FIR, the Court refused to exercise its power under Section 528 of the BNSS to quash the proceedings and Dismissed the petition With Costs of \u20b950,000.<\/p>\n\n\n\n
