He said that every document in a case file must be scanned, properly organised, bookmarked and uploaded to the digital record on the same day.

Only Stay Application Uploaded, Main Petition File Missing.

The issue came to light while the Court was hearing a criminal miscellaneous petition through the Paperless Module.

The Court found that the complete scanned copy of the main petition was missing from the digital record, while only the stay application had been uploaded.

The Court had consequently sought an explanation from the concerned person responsible for uploading the file.

The explanation submitted by the concerned clerks and the authorised signatory found to be unsatisfactory.

The Court observed that “the lethargic approach taken by the concerned person causes the difficulty to the court on working on paperless module.

The court also noted that even if there had been a power outage on June 25 and 26, 2026, the documents could have been uploaded on the following working days.

HC Flags ‘Casual Approach’ Towards Digital Records

Justice Dhand also noted that the Court was regularly coming across cases where petitions, replies, rejoinders, applications, additional affidavits and other documents were not being uploaded properly or on time.

Such lapses, the Court said, create difficulties for courts functioning through the Paperless Module.

Court took a note of, 2020 Standing Order

The Court also examined a Standing Order issued by the Registrar General on November, 2020, which had laid down the roles and responsibilities of High Court staff for scanning criminal case files and operating paperless courts.

The Bench observed that the 2020 order was confined to criminal matters, whereas the High Court is now moving towards paperless functioning across civil, criminal, writ and miscellaneous cases.

The Court therefore said that the existing Standing Order requires suitable amendments to reflect the changing technological environment and said the 2020 standing order not enough.

‘Paperless Courts’ a revolutionary step

The Court observed that the shift to paperless functioning as a major transformation in the justice delivery system, rather than merely a technological upgrade.

Noted that digital functioning saves judicial time, reduces the burden on the Registry, minimises the risk of loss or damage to records and provides judges with access to pleadings around the clock.

However, these benefits, the Court noted, can only be achieved when case records are complete and uploaded on time

Every Document to Be Scanned and Uploaded the Same Day

The High Court said the paperless system should now cover all cases pending before the Court, including civil, criminal, writ and miscellaneous matters at both the Jodhpur Principal Seat and Jaipur Bench.

The Court also said that every stakeholder must have clearly defined responsibilities and that every document in every case file should be scanned, bookmarked, indexed and uploaded on the same day.

The court remarked “Unless accountability is fixed, the dream of a paperless Court will remain on papers only.”

Order to be place before the Chief Justice

The Court accordingly directed the Registrar to place the order before the Chief Justice on the administrative side for consideration of a comprehensive and amended Standing Order.

Jaipur: The Rajasthan High Court has taken a strong view of the casual approach in uploading court records on its Paperless Module, observing that incomplete digital files are making it difficult for judges to hear cases and can ultimately delay the delivery of justice.
