{"id":9696,"date":"2026-09-12T07:09:29","date_gmt":"2026-09-12T07:09:29","guid":{"rendered":"https:\/\/lawsandlegals.com\/english\/?p=9696"},"modified":"2026-09-12T07:10:03","modified_gmt":"2026-09-12T07:10:03","slug":"government-quarter-occupant-gets-protection-from-rajasthan-hc-over-alleged-subletting","status":"publish","type":"post","link":"https:\/\/lawsandlegals.com\/english\/government-quarter-occupant-gets-protection-from-rajasthan-hc-over-alleged-subletting\/","title":{"rendered":"Government Quarter Occupant Gets Protection from Rajasthan HC over alleged subletting ."},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Jaipur:<\/strong> The Rajasthan High Court has granted interim protection to a government employee facing dispossession from his official residential accommodation over an allegation of subletting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Anand Sharma passed the interim order on a petition filed by Hari Om Singh, challenging the action taken against him by the authorities against the government quarter allotted to him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute arose after the petitioner was served a notice alleging that persons other than him were residing in the allotted accommodation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his reply, petitioner explained that his daughter was present in the quarter when the alleged inspection was conducted and that she was admittedly a member of his family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the respondent department subsequently passed an order, making a different allegation that the petitioner had sublet the government accommodation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioner challenged the action, stating that the inspection report was not supplied to him and that the allegation in the final order was different from the original notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While taking the note of the petitioner\u2019s submissions regarding the change in the allegation and the fact that the alleged inspection report had not been supplied to him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Upon which the State\u2019s counsel sought two weeks\u2019 time to file a reply, which the Court granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also said that the respondent authorities shall not dispossess the petitioner from the government accommodation until the next date of hearing that is on September, 28th.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also clarified that the appearance of the Additional Government Counsel would not prevent the State from moving an appropriate application for vacation of the interim protection, if so advised.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jaipur: The Rajasthan High Court has granted interim protection to a government employee facing dispossession from his official residential accommodation over an allegation of subletting.
