This can unnecessarily delay the hearing, particularly when the accused is already in custody.

HC Flags 15–20 Day Delay in Getting Case Diaries

The Court noted that in cases involving petty offences, the entire case diary may not always be necessary to decide a bail application. Waiting for the complete record in every case could therefore delay consideration of personal liberty.

Police to Send Factual Report Within 3–7 Days

Following the submissions of the Government Advocate and suggestions from the lawyers.

The Court directed the GA-cum-AAG office to seek the FIR-related factual report at the first instance, preferably within 3–7 days of filing the bail application.

The concerned SHO/Investigating Officer will provide the report, and the GA office will maintain a record of its communication with the police or investigating agency.

Where the factual report is sufficient, the bail application can be heard and decided on merits without waiting for the case diary.

The Court further clarified that the case diary may be called for only when the Court considers it necessary, depending on the facts of each case.

SC Directions on Bail Also Taken into Account

The High Court referred to the Supreme Court’s observations said that the procedure was aimed at removing avoidable delays in cases involving the personal liberty of persons in custody.

The High Court said the Supreme Court’s directions needed to be adopted to reduce unnecessary delays and ensure that bail applications are considered on merits at the earliest.

HC Directs GA Office to Get FIR Reports Within 3–7 Days to Avoid Delays in Bail Hearings Jodhpur: The Rajasthan High Court has stepped in to address delays in bail hearings, directing the Government Advocate-cum-Additional Advocate General (GA-cum-AAG) office to obtain factual reports from the police within 3 to 7 days of a bail application … Read more

[69,29
3345,3347,1675,607,3341,1677,3342,3344,3343,972,1267,3346,659,43
post-9779","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-rajasthan-high-court","category-top-stories","tag-aag-office","tag-additional-advocate-general","tag-bail-application","tag-bail-delay","tag-bail-hearing","tag-case-diary","tag-factual-report","tag-ga-office","tag-government-advocate","tag-jodhpur","tag-police-investigation","tag-police-report","tag-rajasthan-hc","tag-rajasthan-high-court
["GET
