Recruitment Process Can Move Ahead

Appearing for the State, Additional Solicitor General Aishwarya Bhati, assisted by counsel Aneesha Rastogi, submitted that the High Court’s Division Bench ought not to have stayed the recruitment process initiated pursuant to the April 30 notification.

The State told the Supreme Court that the writ petitioners were still continuing in service as Guest Faculty and that there was, as of then, no proposal to remove them.

After hearing the submissions, the Supreme Court issued notice to the respondents, returnable on November 2.

In the meantime, the Court ordered that the effect and operation of the Rajasthan High Court’s impugned order would remain stayed.

Recruitment Can Continue, But Results Subject to SC Verdict

The Supreme Court, however, attached an important condition to the continuation of the recruitment process.

It directed that the outcome of the recruitment process pursuant would remain subject to the final outcome of the SLP.

Thus, the interim order does not finally decide the dispute concerning the rights of the Guest Faculty teachers.

It allows the recruitment process to proceed while keeping its eventual outcome subject to the Supreme Court’s final decision.

HC Had Granted Interim Protection to Guest Faculty

The dispute before the High Court involved Guest Faculty teachers working as Assistant Professors in government colleges under the Rajasthan College Education Society.

The High Court had granted interim protection to the concerned teachers, allowing them to continue in service while the related petitions and appeals remained pending.

The Court also stayed the recruitment advertisement issued for appointing new contractual teachers in place of those already working on contract.

RSSB Recruitment Dispute Referred to Larger Bench Amid Differing HC Views

Questions concerning the recruitment process and the role and authority of the Rajasthan Staff Selection Board (RSSB) had also arisen before different Benches of the High Court, with differing views leading to directions for consideration by a larger Bench.
The High Court had further directed that its interim order would apply to similarly placed pending matters, without requiring each affected teacher to file a separate petition for identical relief.

Rajasthan Government Moves Supreme Court

Challenging the July 14 High Court order, the State of Rajasthan approached the Supreme Court through a Special Leave Petition.

The matter came before the Bench of Justice Prashant Kumar Mishra and Justice Shree Chandrashekhar, with the State represented by ASG Aishwarya Bhati.

The Supreme Court has now issued notice to the respondents and fixed November 2.

For now, the recruitment process can proceed, but its outcome will remain subject to the final decision of the Supreme Court in the pending SLP.

State Challenges HC’s July 14 Stay;
