The appellant, Shyam Prakash, sought compensation for his injuries as well as the damage caused to his car.

The Tribunal had awarded compensation, including damage to the vehicle, but declined to rely on the surveyor’s report which assessed the vehicle’s loss at ₹10.90 lakh.

The Tribunal had questioned the report primarily because the vehicle was inspected more than a year after the accident and because of an apparent discrepancy concerning the surveyor’s licence.

The Court, however, found both grounds unsustainable.

Mere Delay in Inspection Not Enough

The Court observed that merely because the damaged vehicle remained exposed to sun and rain for about a year could not, by itself, establish that the surveyor was unable to accurately assess the accident-related damage.

There was no material showing that the vehicle had undergone substantial deterioration which affected the assessment of the damage attributable to the accident.

The High Court also found that the Tribunal had wrongly understood the licence details mentioned in the survey report.

Surveyor Report Not Conclusive, But Cannot Be Disregarded Arbitrarily

The Court also clarified that a surveyor’s report is neither conclusive nor binding on a Tribunal. However, once a duly proved surveyor’s report is available on record, the Tribunal cannot discard it arbitrarily. Disregard must be supported by valid and legally maintainable reasons.

Accordingly, the Court enhanced the compensation as per the survey report, and the appeal was accordingly partly allowed, and the award was modified.

Jodhpur: The Rajasthan High Court has enhanced compensation for vehicle damage from ₹3.50 lakh to ₹10.90 lakh holding that a duly proved surveyor’s report cannot be discarded arbitrarily without valid and legally sustainable reasons.
