Despite Nearly Two Years in Custody of Seven-Year Sentence, Court Refuses Relief; Holds Criminal Background and Pendency of Cases Relevant to Bail
Jaipur: The Rajasthan High Court has rejected the third application for suspension of sentence filed by a convicted accused, holding that his extensive criminal antecedents and 29 pending criminal cases weighed heavily against granting him bail.
Justice Ashok Kumar Jain dismissed the application filed by Rimpy Sardar @ Tejendra Pal Singh, who is presently confined in Central Jail, Kota. The Court observed that although the appellant had undergone nearly two years of custody against a sentence of seven years, the period of incarceration was not even close to 50% of the awarded sentence, while his criminal background remained a significant consideration.
The Court observed that, given the appellant’s criminal background and 29 cases against him, it would be difficult to ensure compliance with conditions even if stringent conditions were imposed.
Accordingly, the third suspension-of-sentence application was dismissed.
