New Delhi: The Supreme Court has sent back PIL to the Rajasthan High Court challenging the alleged allotment of 16.68 hectares of government land in Bajor village, Sikar, to M/s Bajor Desert Safari for setting up a desert safari camp.
A Bench of Chief Justice of India Surya Kant, Justice Joymala Bagchi and Justice Mohana directed the petitioner to file a review petition before the Rajasthan High Court, which will now examine the factual issues involved in the dispute.
PIL Challenging 16.68-Hectare Land Allotment
The PIL sought cancellation of the allotment of Gair Mumkin government land, alleging that the land was being diverted for private use in violation of the applicable norms.
Raised Concerns Over Aravalli Land and Flood Protection
The petitioner also raised concerns over the school playground and other adjoining parcels of land around the Aravallis, claiming that the area acts as a natural barrier to the flow of water from the hills and helps protect nearby villages and agricultural land from flooding.
Petitioner Said HC Misread the PIL
The PIL had earlier been dismissed in limine by a Division Bench of the Rajasthan High Court comprising Justice S.P. Sharma and Justice Maneesh Sharma.
Before the Supreme Court, the petitioner argued that the High Court had misread the actual prayer and controversy and had failed to examine the nature and status of the 16.68-hectare land in Bajor, Sikar.
It was also pointed out that a separate petition concerning part of the disputed land was already pending before a Single Judge of the High Court.
SC Flags Renumbering of School Playground Land
The Supreme Court specifically took note of the issue concerning the school playground land. The Bench observed that the 2-hectare parcel, originally allotted to Government Higher Secondary School, Bajor, was subsequently renumbered.
The Court further noted that this fact apparently was not brought to the notice of the Rajasthan High Court when the PIL was dismissed, warranting a fresh consideration of the issue.
SC Gives Fresh Opportunity Before Rajasthan HC
After considering the factual background, the Supreme Court directed the petitioner to seek review of the earlier High Court order.
The Bench further allowed the petitioner to raise both the issue concerning the school playground allotment and the other disputed parcels of land in Writ Petition No. 6171/2026, pending before the Single Judge.
The matter will now return to the Rajasthan High Court for consideration of the disputed land allotments and the factual issues raised by the petitioner.
The petitioner was represented by AOR Aditya Jain, Advocates Sanwar Chaudhary and Amandeep Chauri.
