Rajasthan HC Calls Niwai Municipal Officials to Court Over Retired Teacher’s Plot Dispute

Jaipur: The Rajasthan High Court has summoned the Chairperson and Executive Officer of the Niwai Municipality in Tonk district to appear personally in a case concerning the possession of a plot and the issuance of a lease deed (patta) to a retired teacher.

Justice Ashok Kumar Jain passed the order while hearing a civil second appeal filed by Madan Lal Gautam, a retired schoolteacher. The Court directed both municipal officials to appear in person at 2 PM on October 26, 2026.

The Court has not yet passed a final order directing the municipality to hand over possession of the plot or issue the lease deed. The matter will be taken up for further hearing on the next date.

Dispute Over Plot in Deendayal Colony Pending Since 2014

The case concerns Plot No. F-56 in Deendayal Colony, also known as Deendayal Nagar, in Niwai, Tonk district.

Gautam approached the High Court seeking possession of the plot and issuance of a lease deed in his name. He had earlier pursued the matter before the lower courts but did not obtain relief.

The trial court dismissed his suit, and the appellate court upheld that decision. Gautam subsequently filed a civil second appeal before the Rajasthan High Court, where the matter has remained pending since 2014.

Counsel Highlights Retired Teacher’s Age

During the hearing, advocate Prahlad Sharma, appearing for Gautam, informed the Court that his client had lost the case before both the trial court and the appellate court.

Sharma submitted that Gautam was a senior citizen who had retired from service as a schoolteacher and urged the Court to facilitate a resolution of the dispute.

The Court was also informed that the appellant did not wish to pursue the dispute concerning his rights against respondent No. 3. His principal concern was to resolve the issue relating to possession of the plot and issuance of the lease deed.

Municipal Chairperson and Executive Officer Ordered to Appear

After considering the submissions, the case record and the suggestions made during the hearing, Justice Ashok Kumar Jain directed the Chairperson and Executive Officer of the Niwai Municipality to appear personally before the Court.

The Court office was also directed to ensure that copies of the order were communicated to the concerned officials.

The matter has been listed for further hearing on October 26, 2026, at 2 PM, when the two municipal officials are required to be present.

The High Court is yet to decide the appellant’s request for possession of Plot No. F-56 and issuance of the lease deed.

Appearances: Advocate Prahlad Sharma appeared for the appellant. Advocates Lakhan Sharma, Sandeep Jain and Amit Sharma appeared for the respondents.
