J&K HC Seeks UT Government’s Response on PIL Seeking Early Appointment of Regular Advocate General

“Post Should Ideally Be Filled by Next Hearing”: J&K HC on Regular Advocate General Appointment

Jammu: The High Court of Jammu & Kashmir and Ladakh has sought the Union Territory government’s response to a PIL seeking the early appointment of a regular Advocate General for Jammu & Kashmir.

A Division Bench of Chief Justice Pushpendra Singh Bhati and Justice Rajnesh Oswal issued notice to the Chief Secretary and Law Secretary and asked them to file their response by October 21.

The PIL points towards the prolonged vacancy in the constitutional post and says it is affecting important statutory functions.

PIL also specifically highlights the J&K Advocates’ Welfare Fund Trustee Committee, where the Advocate General is the ex-officio Chairperson.

During the hearing, the Bench observed that the post “should ideally be filled by the next date of hearing.”

The petitioner clarified that the plea is not seeking the appointment of any particular person. It only seeks timely action from the authorities to fill the post in accordance with law.

The case will next be heard on October 21.
