Jaipur: The Rajasthan High Court has granted interim relief to three candidates involved in a dispute over recruitment to Assistant Professor (Super Speciality) posts in the Medical Education Department by the Rajasthan Public Service Commission.
The candidates, Dr. Pranav Raja Yadav, Deepika Gehlot, and Shikha Kumari Meena, challenged RPSC’s decision to reject their candidature for Assistant Professor posts in the super-speciality subject of Uro-Oncology.
They argued that they had acquired the required educational qualifications and experience before the interview date and had also qualified for the interview through the written examination.
The petitioners contended that under the Rajasthan Medical Service (College Branch) Rules, 1962, a candidate who possesses the prescribed qualifications by the date of the interview is eligible to participate in the selection process.
They further argued that excluding them from the interview despite qualifying in the written examination was unjustified.
After a preliminary hearing, Justice Chandra Prakash Shrimali observed that the matter required detailed consideration and that the petitioners had raised an arguable case. The Court noted that the relevant rules appear to recognize eligibility based on qualifications held at the time of the interview.
As an interim measure, the Court directed RPSC to allow the petitioners to participate in the interview provisionally, provided they possess the prescribed qualifications and experience by the interview date and are otherwise eligible on the basis of their written-examination merit.
However, the Court clarified that the petitioners’ results cannot be declared without prior permission of the Court. Their results are to be kept in a sealed cover until further orders.
The interim arrangement will remain subject to the final outcome of the petitions.
Since all three petitions raise similar legal issues, the Court heard them together and passed a common order.
Notices have been issued to the State Government and other respondents, and the matter will be heard again after two weeks.
